A Real Estate Buyer’s Broker will typically advise a Real Estate BUYER that they need:
1. A Professional Engineer to evaluate engineering issues concerning the property including Title V Septic System Inspection Requirements, Wetlands Protection Regulations, Waterfront Licensing, Stormwater Drainage, U.S. FEMA Flood Elevation Certification. If you are buying land or new construction, your Professional Engineer can advise you on matters such as groundwater table, structural engineering, site grading and drainage, street access, etc.
2. A Professional Land Surveyor to review and/or perform a Property Line or Easement Survey and at a minimum, prepare a Mortgage Plot Plan, review Zoning building setbacks for possible future building expansion issues.
3. An Attorney to review legal matters associated with the purchase of a house (Contract Offer to Purchase, Purchase and Sale Contract Agreement, Subdivision Homeowner’s Associations, property restrictions, Loan Commitment Agreement, Form of the Deed, Land Title issues, Transaction Closing, and Recording, Homestead Act Registry Filing). An Attorney can also review Zoning use matters for possible building expansion or other use matters (such as possible in-law apartment expansion).
Having an Attorney is so important that Massachusetts Regulations state that No broker or salesperson shall advise against the use of an attorney in any real property transaction, Professional Real Estate Standards of Practice.
4. A Construction/Engineering Inspection of the Building and Premises. This inspection of the building and premises can detect problems with the construction of the building such as, water intrusion, plumbing defects, foundation and other structural issues, etc.

A word of caution for Home Buyers
Unless you engage a buyer’s broker to represent and assist you in buying Real Estate, you can not be assured that the broker is protecting your best interests. This means that you should never give important information about your motivation, financial capacity, time needs, etc, to a Seller’s listing broker. The Seller’s listing broker is obligated to tell the Seller everything that the listing broker knows about a prospective buyer.
